In 2015, Attorney General Mark Herring laid the groundwork for local control of hydraulic fracturing with his opinion advising localities that they can use zoning ordinances to regulate this very industrial practice that comes with very real impacts to local infrastructure.
Tuesday, Aug. 16, King George County became the first locality in Virginia to move forward with actual regulations aimed at reigning in fracking by setting clear limits on where it can take place. As one of five counties in the gas-rich Taylorsville Basin region, King George has set the pace and the oil and gas industry is already threatening litigation. For the other Taylorsville Basin localities to follow King George’s lead, they’ll need to know that Virginia’s top legal office is still in their corner.
